BENGALURU, 15 MAY
The Karnataka High Court has directed that no coercive action be taken against singer Sonu Nigam until the next hearing regarding a recent criminal case linked to allegedly offensive remarks made during a concert. The court also permitted him to testify via video conferencing if required by the investigating officer (IO). Should a physical appearance be insisted upon, the officer may visit him, with Nigam to cover the related expenses.
The case arose from a complaint following an incident at a concert where some Kannadiga fans requested Nigam to perform in Kannada. The singer allegedly took offence to the tone of the request and reportedly remarked, “This is why Pahalgam happened,"
During the hearing, Nigam’s lawyer, Dhananjay Vidyapati, argued that the complaint was motivated by a desire for publicity and that the supposed offence of public mischief was unjustified. In contrast, the State counsel maintained that Nigam’s intent behind the comments needed thorough examination and highlighted his lack of cooperation.
“Whether the comments were intentional or not cannot be adjudicated under Section 482 (CrPC). He has not cooperated with the investigation. He could have at least said he was busy,” the State submitted.
The court acknowledged the State’s stance, emphasising that should Nigam comply with the investigation, no coercive action would be taken. The filing of a final report in this case has been stayed until the next hearing date.
The court recorded the State’s submission that no coercive steps would be taken if Nigam cooperated with the investigation. It stayed the filing of any final report in the case until the next date of hearing.
